Delve Jewellery B.V.
Article 1 – Definitions
In these general terms and conditions:

Delve Jewellery: Delve Jewellery B.V., established in Amsterdam, the Netherlands.

Consumer: a natural person acting for purposes outside their trade, business or profession.

Distance contract: a contract concluded between Delve Jewellery and the consumer within an organised system for distance selling.
-
Right of withdrawal: the possibility for the consumer to withdraw from the contract within the withdrawal period.
-
Withdrawal period: the period of 14 calendar days from receipt of the product.
-
Durable medium: any instrument enabling the consumer to store information in a way accessible for future reference.
-
Bespoke / Made-to-order product: jewellery manufactured specifically according to the consumer’s specifications or clearly personalised.
-
Working day: Monday to Friday, excluding public holidays in the Netherlands.

Article 3 – Applicability

These terms apply to all offers and contracts concluded between Delve Jewellery and a consumer.

The terms are made available electronically before contract conclusion and may be stored on a durable medium.
-
Deviations are only valid if agreed in writing.
Article 4 – The Offer

Offers are without obligation unless explicitly stated otherwise.
-
Product images are as accurate as possible. Minor variations in colour, finish, or size due to screen settings or artisanal production do not constitute defects.
-
Obvious errors in pricing or description do not bind Delve Jewellery.
Article 5 – The Contract
-
The contract is concluded once payment is successfully completed.
-
Confirmation is sent electronically.
-
Delve Jewellery reserves the right to refuse orders in case of fraud suspicion or pricing errors.
Article 6 – Right of Withdrawal
1. Standard Products
Consumers may withdraw within 14 calendar days after receiving the product.
2. Conditions
-
Written notification within 14 days.
-
Return within 14 days after notification.
-
Item must be unused, undamaged and in original packaging.
-
Return shipment must be insured.
-
Return shipping costs are borne by the consumer.
Risk of return remains with the consumer until receipt.
3. Exclusion
The right of withdrawal does not apply to:
-
Bespoke or made-to-order jewellery;
-
Jewellery produced to the consumer’s specifications;
-
Personalised items.
4. Refund
Refunds are processed within 14 days after receipt of returned goods via the original payment method (credit card or PayPal).
Article 7 – Consumer Obligations During Withdrawal Period
The consumer must handle the jewellery with care and only inspect it as would be permitted in a physical boutique. Devaluation due to improper handling may be deducted from the refund.
Article 8 – Costs in Case of Withdrawal
The consumer bears the direct costs of insured return shipment.
Article 9 – Trader Obligations in Case of Withdrawal
Delve Jewellery reimburses all payments received, excluding premium shipping costs, within 14 days after receiving the returned goods.
Article 10 – Exclusion of Withdrawal Rights
Withdrawal rights are excluded for:

Bespoke or personalised jewellery;
-
Products subject to financial market fluctuations beyond Delve Jewellery’s control.
Article 11 – Prices

All prices include VAT unless stated otherwise.
-
Prices may change before contract conclusion.
-
Obvious pricing errors may be corrected.
Article 12 – Conformity and Warranty
-
Products comply with EU statutory conformity requirements.
-
Normal wear and tear, misuse, accidental damage or improper care are excluded.
-
Delve Jewellery offers a repair service.
-
Shipping costs for warranty or repair claims are borne by the consumer unless otherwise agreed.
Article 13 – Delivery and Implementation

Delivery is worldwide.
-
Estimated delivery time:
-
Netherlands/Belgium: 1 working day
-
Rest of the world: approx. 3 working days
-
-
Certain products may be made-to-order and require extended delivery time.
-
Risk transfers to the consumer upon delivery.
Article 14 – Duration and Termination
Not applicable unless otherwise agreed, as Delve Jewellery does not operate subscription services.
Article 15 – Payment

Payment methods: Credit Card and PayPal.
-
Payment must be completed before shipment.
-
In case of non-payment, Delve Jewellery may suspend delivery.
Article 16 – Complaints Procedure

Complaints must be submitted in writing to hello@delvejewellery.com without undue delay.
-
A response will be provided within 14 days.
-
The consumer must allow a reasonable period for resolution.
Article 17 – Disputes and Applicable Law
-
All agreements are governed exclusively by Dutch law.
-
Disputes shall be submitted exclusively to the competent court in Amsterdam, the Netherlands.
Article 18 – Intellectual Property
All designs, trademarks, product names, imagery and content remain the intellectual property of Delve Jewellery B.V. and may not be reproduced without written consent.
Article 19 – Liability

Delve Jewellery’s liability is limited to the purchase price of the product concerned.

Indirect damages, consequential damages or loss of profit are excluded unless mandatory law provides otherwise.
Article 20 – Amendments
Delve Jewellery may amend these terms. Amendments apply to future contracts only.
